Terms & Conditions

Definitions

The ‘Seller’ is defined as ‘Botanico’, the ‘Buyer’ means the person who buys the goods ‘Goods’ is defined as the items to be supplied by the Seller to the Buyer.

General

By ordering from Botanico, you will be legally bound by the terms and conditions set out herein. These terms and conditions may be modified from time to time. Any amendments will be updated and those clients currently in contract will be notified.

Basis of sale

We require a £100 non refundable deposit to confirm an order and hold the date. Booking are not confirmed until we have received your deposit AND you have received a ‘Booking Confirmation’ from us via email. The remaining balance will then be due 4 weeks before delivery. If you have ordered a sample box or paid for a consultation, this will be deducted from your final invoice as long as your order exceeds £500. If the booking is made with less than four weeks before the delivery date, the full amount will be due upon booking. If final payment is not made by the due date set out in your invoice, we reserve the right to cancel your booking and your sample / consultation fee will not be re-imbursement.

Cancellation Policy

In the event of cancellation by yourself, charges applicable are as follows:

  • More than 12 weeks prior to the delivery date: Booking fee only.

  • 12 weeks to 4 weeks prior to the date: Booking fee plus 50% of the remaining balance.

  • Less than 4 weeks prior to the date: Full amount is due

 

Any payment previously made is not refundable. In the unlikely event that Botanico need to cancel your booking, monies paid will be refunded in full. Botanico reserves the right to cancel, amend or suspend a booking and operation of this contract due to illness or if events occur which are in the nature of force majeure including (without prejudice) : fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies, or any other event outside the control of Botanico. Botanico shall not be liable for any breach in contract arising from such an event.

Postponement

In the event of a postponement, the payment due remains the same as a cancellation. We will carry any monies paid forward to a new date, subject to our availability. Please be aware we will only amend a date once, after this it will be treated as a cancellation.

Amends

Amends can be made up to 8 weeks before the delivery date (wedding cake) and up to 2 weeks before the delivery date (for a celebration cake). A new order confirmation will be sent detailing any changes and the new cost if applicable. Should any changes be made after that time, there will not be a reduction in the price even if your new design is cheaper that the original booking.

Quotations

Quotations are valid for 30 days from the date of quotation. This does not guarantee our availability for 30 days, only the price. Bookings will only be accepted if we still have availability for the date.

Your cake

Sketches, samples and photographs are to give you a rough idea of what your finished cake will look like. Whilst these are usually fairly accurate, we cannot guarantee an exact match and as each cake is handmade individually, there may be a natural variation with some colours. The buyer accepts that any samples shown are representative of the goods they should expect to receive but not an exact copy. Once we have finalised your design, you will be sent a ‘Cake details ' document. It is important that you check all details and bring to our attention any discrepancies at this stage. We will ensure that the cake shall conform to the description in the order confirmation, be of satisfactory quality and conform with all relevant Food Safety regulatory requirements in the UK. This warranty does not apply to any fault in the cake arising from your negligence, damage or accident, or your failure to follow our instructions, or any modifications you may attempt. After delivering and setting up your cake, we will photograph for our records, and confirm to you that the cake has been set up safely. The person receiving your cake order is responsible for its safety after we have delivered and set up. This person will be given our ‘Cake Important Information’ sheet which will detail any allergens, non edibles and storage advice. We cannot be held responsible for the safety and suitability of the venue, table, room etc. If in the event we cannot gain access to the area to set up, we will follow the instructions of the person receiving the cake order. We cannot be held responsible for any cakes that are collected, once they have left our premises. We will advise on how we feel the cake should be transported and provide non slip matting if required, but safe transportation will not be our responsibility, unless we have been booked to deliver and set up the cake ourselves. Our cakes have approximately 5” deep tiers as standard. If you require a different depth, this must be stated before we provide our quotation. Ingredients and allergens

We bake with nuts, seeds, eggs and many other allergens in the same kitchen so our cakes are not suitable for those with allergies. We do offer various dietary options, for example recipes without Gluten and vegan cakes too, but we cannot guarantee these will be free from trace of allergens either. We may use non edible items in your cake, such as dowels to support tiers, or wires to attach flowers. These will be detailed in your ‘Cake Important Information’ sheet and handed to the person receiving your cake order. We do not use fresh flowers on our cakes. If you decide to add fresh flowers yourself you will be fully responsible for ensuring that you have liaised with your florist to make sure that your flowers are food safe and free from pesticides and chemicals. We can accept no responsibility for any modifications that you make to a Botanico cake after we have delivered and set up as per the detail on your order form.

Equipment hire

Please note that we do not hire out cake stands, tablecloths or cake knives. It is your responsibility to ensure the venue or your catering supplier will provide these.

Complaints

Complaints are very rare but we do take them very seriously. We will need you to provide photographic evidence and put your complaint into an email within 3 days of receiving your cake. Any refunds will be entirely at our discretion.

Prices and Payment method

All prices exclude VAT (Botanico is not VAT registered). All quotations are provided in £GBP. All payments must be made via bank transfer to:

Tuition Bookings

The cancellation and postponement policy as above is also applicable to tuition bookings.

Our policy on cancellation by Botanico as above, also applies.

General

We reserve the right to use any sketches and photographic images of your cake to use for our own advertising through social media, web based, brochures and galleries.
